General Terms and Conditions (GTC)

For the Happy Pets Care online shop (happypetscare.com) : These General Terms and Conditions apply to all orders placed via the Happy Pets Care online shop. The shop is operated by Jared Oosterhuis, residing in Zurich, Switzerland. By placing an order, customers accept the following terms and conditions in their currently valid version. Deviating provisions only apply if they have been expressly agreed to in writing. Offer and conclusion of contract: The presentation of products in the online shop serves solely to showcase the product range and does not constitute a legally binding offer. A binding contract is only concluded when an order is reviewed by us and subsequently confirmed by email. This order confirmation constitutes acceptance of the offer. Should a product unexpectedly be unavailable, we reserve the right not to accept the order. In this case, the customer will be informed immediately. Prices and terms of payment: All prices stated in the shop are final prices in euros. They include all price components, but not shipping costs, if any. Payment is accepted exclusively via the payment methods offered at checkout, including Shopify Payments, credit card, PayPal, and other common payment methods. We reserve the right to exclude or modify individual payment methods in specific cases. Shipping, delivery, and delivery times: Shipping is handled by international shipping providers. Delivery time is generally between 7 and 14 business days, depending on the destination country, the shipping partner's workload, and potential delays due to customs or logistics. As we operate on a dropshipping model, extended delivery times may occur in individual cases. We have no direct control over transport routes, intermediate storage, or delays caused by external service providers. Should a delivery take an exceptionally long time, we will, of course, assist our customers with tracking their shipment. Retention of title: The delivered goods remain the property of Happy Pets Care until full payment has been received. Resale, processing, or encumbrance of the goods before full payment is prohibited. Right of withdrawal: Customers from the European Union have a statutory right of withdrawal of 14 days from receipt of the goods. The exact terms, deadlines, and procedures are described in detail in our cancellation policy. Please note that certain products may be excluded from returns for hygiene reasons if they have been opened or used. Returns and refunds: Returns are generally possible. The customer bears the return shipping costs unless the delivered item was faulty, damaged, or incorrectly delivered. After receipt and inspection of the returned item, the refund will be issued via the original payment method. We reserve the right to claim reasonable compensation for diminished value if the goods are returned in a condition resulting from excessive use. Warranty and liability for defects: The statutory warranty rights apply. Should a product be faulty or not match the description, customers can contact our support team at happypetscarehelp@outlook.com . We always strive for a quick and customer-friendly solution. Please note that slight variations in color, size, or material are possible due to different production batches or screen displays and do not constitute a defect. Liability: Happy Pets Care is liable only for damages caused by intentional or grossly negligent conduct. Any further liability – in particular for indirect damages, lost profits, or consequential damages – is excluded to the extent permitted by law. Liability for slight negligence is excluded, unless it involves a breach of essential contractual obligations. Applicable law and jurisdiction: All legal relations between Happy Pets Care and its customers are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). To the extent permitted by law, the place of jurisdiction shall be the registered office of the shop operator.
